TERMS OF SERVICE – Northeast Paddle Sports LLC

Welcome to Northeast Paddle Sports. By booking, renting, or participating in any of our kayak activities, you agree to the following Terms of Service. Please read them carefully.

1. Eligibility

  • Participants must be 12 or older.

  • All participants must be able to swim unassisted and be in reasonably good physical health.

  • You agree to follow all instructions given by our staff.

2. Assumption of Risk & Liability Waiver

  • Kayaking and related activities involve inherent risks, including injury or death from weather, water conditions, or other natural hazards.

  • By participating, you acknowledge these risks and agree that Northeast Paddle Sports, its owners, and staff are not liable for injury, loss, or damage, except where prohibited by law.

  • You are responsible for your own safety and the safety of any minors under your supervision.

3. Safety & Conduct

  • You must wear a properly fitted personal flotation device (PFD) at all times.

  • Alcohol, drugs, or impairing substances are strictly prohibited before or during activities.

  • Reckless, dangerous, or disruptive behavior will result in immediate termination of your participation without refund.

4. Booking, Payment & Cancellations

  • Bookings are confirmed upon full payment.

  • Cancellations made 24 hours before your trip receive a full refund. No-shows or late cancellations will not be refunded.

  • Northeast Paddle Sports reserves the right to cancel or reschedule trips due to unsafe weather or water conditions. In such cases, you will receive a full refund.

5. Equipment Use & Damage

  • Equipment provided must be returned in the same condition it was issued.

  • You are responsible for loss or damage beyond normal wear and tear and agree to pay repair or replacement costs.

6. Weather & Conditions

  • Trips may be delayed, shortened, or altered for safety reasons.

  • We are not responsible for changes in weather after departure; no refunds will be issued once the activity begins unless safety requires ending the trip early.

7. Governing Law

  • These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law provisions.

  • Any disputes will be resolved in the courts of Ocean Country, NJ.

By booking or participating in our activities, you confirm that you have read, understood, and agree to these Terms of Service.
